Özet:

SUMMARY

The subject of my thesis is dowry (marriage setlement) according to Sunnah (practies and rules derived from the Prophet’s own habits and words). Dowry is a kind of property or Money given by the husband upon marriage. The main purpose of dowry is to incriase the respect towards woman

The amount of dowry is decided by both parners just before or at the marriage ceremony. There are two possibilities for deliver or payment of dowry. First, mehr-i muaccel, part of wife’s  dowry paid by husband just upon marriage. If he does not pay this kind of dowry, he can not force the wife to cosummate the marriage. Second, mehr-i müeccel, partf of dowry paid by the husband in case of divorce or widowhood.

In Christianity, women had to collect Money and property in order to attract man to herself for marriage. This was called ‘drahoma’. This is just opposite of the Islamic rules.

Dowry can be studied in two topcs according to its nature.

1. Mehr-i musemmâ; the amount of dowry is decided on aggrement by both partners.

2. Mehr-i misil; the amount of dowry is determined by society’s attitude (like 60 g or 80 g gold necklace, etc.)

The minimum amount of dowry 10 dirhem (28g) of silver, which was approximately equal to the cost of two sheep in the first ages of Islam.

Upon divorce, the husband should pay all of the dowry to the wife if not given before. This action is though of a kind of difficulty for divorcing.

The necessity of dowry is laid down by both Quran and sayings of Prophet.

The amount of dowry that will be given to the wife upon marriage is determined by the average amount accepted in the society.

As a ruselt, I tried to find out what a dowry is according to Islam and its sources, Quran and Sunnah.
