Özet

 

Türk edebiyatında toplumcu gerçekçiliğin öncü isimlerinden Orhan Kemal’in (1914-1970) romanları yazıldığı dönemin siyasi, sosyal ve ekonomik koşulları yanı sıra ülkenin idarî ve hukukî işleyişindeki gerçekliğe ayna tutar. Yazar, kendi fikir dünyasında yaşadığı sorgulamaları romanlarına suç, ceza, hak ve adalet kavramları bağlamında gerçek bir aydın duyarlılığıyla yansıtır.

Toplumsal hukuk işleyişinde sıkı bir gözlemci olduğu; işçi ve işveren konulu romanlarında çoğu kez bir hukuk adamı kişiliğini yarattığı görülen Orhan Kemal, Suçlu (1957) romanını da adeta bir hukuksal inceleme konusu yapmıştır. Roman, bir çocuğun suçlu damgası yemesine neden olan toplumsal gerçekleri çarpıcı bir biçimde ele alır. Türk edebiyatında “Suça Sürüklenen Çocuk” kavramının en iyi anlatımlarından biri olan bu eser, çocukların bazı dış etkenlerle suça itildikleri; bu durumun sorumlusunun da toplum olduğu tezine dayanır. Eserin amacı, sanat kaygısından çok bu konuda evrensel hukuku gözeten yasal düzenlemelere ön ayak olmaktır. Bu nedenle romanın edebiyat-hukuk ilişkisi kapsamında suçbilim açısından incelenmesi ayrı bir önem taşır.

Considered among the masters of Turkish Literature, Orhan Kemal’s novels (1914-1970) mirror the era’s political, social, economic conditions and the reality in the managerial and judicial process of the country, as well. The writer reflects his own questioning in his novels in terms of the concepts of crime, punishment, justice with a realistic sensitivity of an artist.

As a careful observer in the process of sociological jurisprudence, Orhan Kemal, who is often observed to create a lawyer character in his works, again employs “the subject of judicial analysis” in his novel entitled Guilty. The novel conspicuously deals with the social realities that cause a child o be labelled as guilty. This novel, which is among the best narrations of the expression “the child pushed to crime”, is based on the thesis that children are pushed to crime by some

exogenous factors and the society is the main blameworthy for this. The purpose of this work is to take the lead in legal regulations based on universal law. Therefore, analysing this work in terms of criminology within the framework of literature-law relationship is of special importance.
